The Contaminated Land (England) Regulations 2012 was a statutory instrument enacted on 6 April 2012 under powers conferred by Part IIA of the Environmental Protection Act 1990, amending and superseding the Contaminated Land (England) Regulations 2006. The instrument extended the regulatory framework governing the identification, remediation, and liability assignment of contaminated land sites in England, most notably by introducing a new category of "special sites" encompassing land affected by radioactive contamination — a class of harm previously handled under separate radiation protection legislation.
Part IIA of the Environmental Protection Act 1990 had established the principal contaminated land regime in England, though it did not come into force until April 2000 following the publication of statutory guidance by the Department of the Environment, Transport and the Regions. The framework placed a duty on local authorities to inspect their areas for contaminated land, defined in section 78A(2) as land where substances were causing or were likely to cause significant harm to human health or the environment, or where pollution of controlled waters was occurring or likely to occur.
The Contaminated Land (England) Regulations 2006 (see /wiki/contaminated-land-regulations-2006) had consolidated earlier instruments and introduced more detailed provisions for remediation notices and cost recovery. By 2009, however, the European Commission had begun scrutinising the United Kingdom's implementation of the Environmental Liability Directive 2004/35/EC, and internal reviews conducted by the Environment Agency (see /wiki/environment-agency-uk) identified a gap in the regime's coverage of radioactive substances deposited in soil. A consultation paper issued by the Department for Environment, Food and Rural Affairs (Defra) in November 2010 proposed extending Part IIA to cover such contamination explicitly, noting that approximately 314 sites of potential radiological concern had been identified across England in a survey completed in March of that year.
The Contaminated Land (England) Regulations 2012 (SI 2012/263) were laid before Parliament on 16 February 2012 and came into force on 6 April 2012. They introduced three principal changes to the 2006 framework.
First, the definition of "special sites" in Schedule 1 was amended to include land contaminated by radioactive substances as defined in section 78YC of the Environmental Protection Act 1990, a section inserted by the Housing and Regeneration Act 2008. Responsibility for such sites was thereby transferred from local authorities to the Environment Agency as the enforcing authority, consistent with the treatment of other technically complex special sites.
Second, the Regulations revised the statutory guidance structure by enabling the Secretary of State to issue separate guidance on the assessment of significant harm attributable to radioactive contamination, distinct from the chemical and biological harm thresholds that had been codified in Defra's 2006 Model Procedures for the Management of Land Contamination (CLR11).
Third, Schedule 2 of the 2006 Regulations was substituted in full, revising the prescribed periods within which enforcing authorities were required to prepare remediation statements and remediation declarations. The substituted schedule extended the standard period from three months to six months in cases where the contaminating substance was designated as radioactive, reflecting the additional technical complexity of radiological site assessments.
The instrument was made under section 78G(5), section 78H(4), and section 78YA(2) of the Environmental Protection Act 1990, as amended.
Reception from local authorities was mixed. The Local Government Association noted in its April 2012 briefing that the transfer of enforcement responsibility for radioactive sites to the Environment Agency was broadly welcomed, as most borough and district councils lacked in-house radiological expertise. However, the Association raised concern that the Regulations provided no transitional funding mechanism for authorities that had already incurred inspection costs in relation to sites now reclassified under the new Schedule 1 definition.
The Environment Agency published updated operational guidance in June 2012, revising its internal protocols for site notification, remediation appraisal, and cost recovery under the new radioactive contamination provisions. The Agency estimated that between 12 and 19 sites then under active investigation by local authorities would transfer to Agency oversight as a result of the reclassification, though that figure was described as provisional in the accompanying technical note.
Environmental law practitioners noted a residual ambiguity in the interaction between the 2012 Regulations and the Radioactive Substances Act 1993, which had not been repealed and continued to govern the disposal of radioactive waste from premises. A subsequent guidance note issued by Defra in September 2012 clarified that the two regimes operated in parallel and that the 2012 Regulations addressed historical contamination in soil rather than ongoing authorised disposals.
The 2012 Regulations remained in force without further amendment until they were themselves subject to review under the Environment Act 2021, which introduced a broader reform of environmental governance following the United Kingdom's departure from the European Union. The Water Framework Directive (see /wiki/water-framework-directive), previously a key interpretive instrument for the controlled waters limb of the Part IIA definition, was retained in domestic law by the European Union (Withdrawal) Act 2018 and continued to inform the assessment of pollution risk at contaminated sites.
The Regulations are regarded by environmental lawyers as having completed the substantive integration of radiological land contamination into the mainstream statutory nuisance and remediation liability framework. A review published by the UK Centre for Environment, Fisheries and Aquaculture Science in 2017 concluded that the 2012 reclassification had produced a measurable improvement in enforcement consistency across the 12 to 14 sites that had transferred to Environment Agency oversight in the period 2012 to 2016.
The Contaminated Land (England) Regulations 2012 have not been the subject of popular cultural treatment. The instrument is cited as a standard teaching reference in environmental law modules at several English universities, and is listed as a core text in the University of Leeds School of Law's LLM Environmental Governance reading list, where it is grouped with the Contaminated Land Regulations 2006 and the Environmental Damage (Prevention and Remediation) (England) Regulations 2015.
